By using this website or booking a charter you agree to these terms. If you do not agree, please do not use the site.

Charter agreement

Every charter is confirmed by a separate written charter agreement between you and the vessel owner or operator. Where that agreement conflicts with these terms, the charter agreement governs.

Rates and availability

Rates displayed on this website are indicative retail rates for the yacht as a whole and are subject to availability, seasonality and confirmation in writing. Fuel, dockage at outside marinas, catering, gratuity and applicable Florida sales tax may be additional unless expressly stated. We reserve the right to correct pricing errors.

Bookings and payment

A booking is confirmed only when a signed charter agreement and the required deposit have been received. The balance is due before departure unless otherwise agreed in writing.

Guest capacity and conduct

Passenger numbers are limited by United States Coast Guard regulations and by the terms of each vessel's insurance. The captain has absolute authority over the vessel, the itinerary and the safety of everyone aboard, and may modify or terminate a charter for safety, weather or conduct reasons. Illegal substances, and any behaviour the captain deems unsafe, are grounds for immediate termination without refund.

Damage and liability

The charterer is responsible for loss or damage to the vessel or its equipment caused by the charterer or their guests. Guests participate in swimming, water toys and all activities at their own risk.

Limitation of liability

To the maximum extent permitted by law, Valparaiso Luxury Management LLC is not liable for indirect, incidental or consequential losses arising from use of this website or from any charter, and our total liability is limited to the amount paid for the charter in question.

Intellectual property

All text, photography and design on this website are owned by or licensed to Valparaiso Luxury Management LLC and may not be reproduced without written permission.

Governing law

These terms are governed by the laws of the State of Florida, and the courts of Florida have exclusive jurisdiction over any dispute.
